Our Expert has completed the CIARB (NI) Expert Witness Training Course. The course covered aspects of acting as an expert witness from duties to conduct and procedure in court. The course was supervised by the Hon Mr Justice Horner.
The primary function of the expert witness is to assist the court in reaching its decision by providing independent expert/technical analysis and opinion on an issue(s), based on the information provided by those instructing.
Experts always owe a duty to exercise reasonable skill and care to those instructing them, and to comply with any relevant professional code. However when they are instructed to give or prepare evidence for civil proceedings they have an overriding duty to help the court on matters within their expertise. This duty overrides any obligation to the person instructing or paying them. Experts must not serve the exclusive interest of those who retain them.
Before our Expert accepts an instruction, we establish the following;
a. We have the appropriate expertise and experience for the particular instruction;
b. We are familiar with the general duties of an expert;
c. We can produce a report, deal with questions and have discussions with other experts within a reasonable time, and at a cost proportionate to the matters in issue;
d. We are available to attend the trial, if attendance is required; and
e. We have no potential conflict of interest
